La Sociología del Derecho, es aquella disciplina que estudia los problemas, las implicaciones, y todo aquello concerniente a las relaciones entre el Derecho y la sociedad. A diferencia de la Teoría del Derecho y de la Filosofía política, el principal problema u objeto de estudio de la sociología jurídica es el de la eficacia del derecho.

La sociología jurídica es para algunos, una rama de la sociología general. Para otros, es una subdisciplina del derecho (En europa se institucionalizo como disciplina). A nivel general, es una aproximación sociológica al derecho.

Los orígenes de la sociología jurídica pueden rastrearse hasta las obras de los clásicos, a saber, Max Weber, Émile Durkheim y Karl Marx. Algunos precursores modernos son Rudolph Von Ihering, Francois Gény, Eugene Ehrlich, Jean Carbonnier, Georges Gurvitch, Roscoe Pound, Axel Hägerström y Renato Treves. Un desarrollo inigualable le han dado a la sociología jurídica Max Weber y Niklas Luhmann, especialmente este último con sus obras Gesellschaft der Gesellschaft y Gesellschaft und Recht, obras que salvo en México son aún prácticamente desconocidas en el ámbito hispanohablante.

Entes académicos

La sociología del derecho ha sido un área relativamente marginal tanto en las facultades de derecho como en las de sociología, lo cual ha llevado a la creación de entes centros de investigación autónomos e independientes. La Asociación Derecho y Sociedad (Law & Society Association) y el Instituto Internacional de Sociología Jurídica de Oñati son ejemplos de entes académicos dedicados al estudio y a la investigación en sociología jurídica. La revista Droit et Societé en Francia también es un medio importante de difusión en temas relacionados con este campo de estudio.

Metodología de investigación

En cuando a metodología de investigación, la sociología del derecho emplea métodos de las ciencias sociales y de la estadística para conocer el comportamiento de los operadores jurídicos (aquellos de los que depende el derecho aplicable, como los legisladores o los jueces) y los destinatarios de las normas.

La investigación sociojurídica es, en un sentido amplio, investigación social, por lo cual esta implica realizar trabajo empírico o trabajo de campo, como entrevistas, sondeos, encuestas, muestreos estadísticos, etc.
